Judgment

The petitioners are seeking regular bail in FIR No.200 dated 24.10.2020 under Sections 147, 148, 149, 323, 341, 307 IPC (Section 326 IPC added later
on), registered at Police Station Sector 36, Chandigarh.
Learned counsel for the petitioners contends that the incident is the outcome of a sudden quarrel due to misunderstanding between friends. It is
alleged that the petitioners were armed with swords and only one injury was on the head of the complainant while other injuries were on the non-vital
parts of the body. The injured have fully recovered from the injuries and with the intervention of the respectables, the matter has been compromised.
He also contends that petitioner No.1 is 18 years of age, petitioner No.2 is 21 years of age while petitioner No.3 is 22 years of age and are in custody
for over 04 months since their arrest on 24.10.2020.
Learned counsel for UT, Chandigarh upon instructions states that challan has been filed and petitioner No.2 is also involved in another case.
Learned counsel for respondent No.3 states that the matter has indeed been compromised.
Heard through video conferencing.
In view of the above especially when the incident is the outcome of a sudden quarrel, the matter has been compromised, the petitioners are in custody
for over 04 months, the COVID-19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of
regular bail to the petitioners.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioners are ordered to be released on
regular bail on their furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
