On an oral request made by counsel for the applicant-petitioner, date of hearing of main petition is preponed to today and it is ordered to be taken on Board.

On 04.10.2023, this Court passed the following order:-
“Custody Certificate dated 04.10.2023 has been filed by the State, which is taken on record.
Upon instructions, State counsel submits that although the recovery effected from co-accused is 10 gram heroin, but the petitioner, who was granted anticipatory bail, absented from the proceedings and his bail bonds were cancelled on 29.04.2022. Counsel submits that the petitioner was arrested in July, 2023 and charges have been framed, but no prosecution witness has been examined.
Counsel for the petitioner submits that the petitioner absented from the proceedings as he was arrested in another criminal case. He requests for an adjournment to show the date of arrest in the second criminal case.
List on 28.11.2023.”
On the basis of prayer made in the application (CRM-45437-2023), counsel for the petitioner seeks and is granted permission to withdraw the petition.
