The petitioner is a stage carrier operator. He submitted application for grant of a fresh stage carrier permit as per Ext.P1 dated 30.5.2022. Ext.P2 is the time - table showing the number of daily trips proposed to be provided. Ext.P1 application was considered by the first respondent in its meeting held on 12.7.2023. As per Ext.P3, though the application was considered on 12.7.2023, the petitioner was directed to submit a modified set of timing proposals providing even number of trips to ill served areas Thottumchal, Kadalmad, Narikkund to Ambalavayal.
The petitioner relies on Ext.P4 judgment of this court in W.P.(C) No.3836 of 2015 and contended that regular permit shall be considered on its own terms and no modification can be insisted upon by the authority, if the applicant is not ready for the same. Therefore, relying Ext.P4 judgment, Ext.P3 is quashed and the first respondent is directed to re-consider Ext.P1 application for regular permit in its own terms within a period of two months from the date of receipt of a copy of this judgment.
