Judgment

Heard Sri Pankaj Tyagi, learned counsel for the petitioner as well as Shri Shashi Dhar Pandey, learned A.G.A. for the State respondents.
The present writ petition has been preferred with the prayer to issue a writ, order or direction in the nature of mandamus directing the respondent authorities to conduct the postmortem of the dead body of the deceased-Arbaz Husain S/o Khalil R/o Village-Bhagatpur, Pulice Station-Bhagatpur, District Moradabad and take the legal action against the private respondent Nos. 5 to 7.
Learned A.G.A. has raised a preliminary objection that without lodging the first information report the prayer as quoted above is being made in the present petition.
After some argument, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to avail appropriate statutory remedy as may be available to the petitioner in accordance with law.
Dismissed as withdrawn with liberty.
