PER SATBEER SINGH GODARA, JM

This assessee’s appeal for assessment year 2017-18 arises against the Commissioner of Income Tax (Appeals)-30 [in short, the “CIT(A)”], Delhi’s order dated 26.06.2025 having DIN and order no. ITBA/APL/M/250/2025-26/1077865058(1), involving proceedings under section 147 r.w.s. 144B of the Income-tax Act, 1961 (hereinafter referred to as ‘the Act’).

Case called twice. None appears at the assessee’s behest. It is accordingly proceeded ex-parte.

2.

It transpires at the outset that we hardly need to delve with the relevant factual matrix at length so far as assessee’s sole substantive ground challenging both the learned lower authorities’ respective assessments and lower appellate findings adding section 68 unexplained cash credits amount of Rs.43,39,941/- in issue is concerned.

3.

This is for the precise reason that we find from a perusal of the case records; and more particularly, as per the learned CIT(A)’s detailed discussion at page 32 in para 9.5 that the assessee had sought to explain that the sum in question of Rs.40 lakhs had been credited in financial year 2015-16 relevant to assessment year 2016-17 then in assessment year 2017-18 herein. We further wish to emphasize here that what all the learned CIT(A) has concluded is that the assessee has failed to explain the total amount of Rs.43.39 lakhs herein since only a sum of Rs.40 lakhs had been received in the said preceding assessment year. We accordingly of the considered view that the impugned addition made in the assessee’s hands does not deserve to be sustained as the same had been credited in the said earlier assessment year only. We thus accept the assessee’s instant solitary substantive ground to delete the impugned addition in very terms.

No other ground or argument has been raised.

This assessee’s appeal is allowed.
