Judgment
M.V. Muralidaran, J
[1] Heard Mr. S. Gunabanta, learned junior counsel to Mr. HS Paonam, learned senior counsel for the petitioner and Mr. Kh. Samarjit, learned DSGI for the Union of India respondents.
[2] Since the respondent No. 5 was not served, this Court by order dated 19.09.2023 directed the petitioner to take fresh notice to the respondent No. 5 returnable by today i.e., 06.10.2023.
[3] When the matter is taken up today, Mr. S. Gunabanta, learned counsel for the petitioner seeks further for taking fresh notice to the respondent No. 5 since they are unable to take to the respondent No. 5 due to the prevailing law and order situation in the State.
[4] Mr. Kh. Samarjit, learned DSGI for the Union of India represented that though the writ petition has been in the year 2019 but till date, the petitioner has not taken effective steps for service of notice to the respondent No. 5 i.e. the State of Arunachal Pradesh. He is strongly objecting in taking fresh notice to the respondent No. 5 by the petitioner since the respondent No. 5 i.e. the Government of Arunachal Pradesh.
[5] Anyhow, by giving one more chance to the petitioner, the petitioner is directed to take fresh steps to the respondent No. 5 by dasti, speed post or registered post returnable by 20.11.2023.
[6] If no steps is taken and notice was not served on the Respondent No. 5, this Court will proceed the matter accordingly on the next date of hearing. No further notice will be permitted for Respondent No. 5.
