Salman vs State of Uttarakhand

Prafulla C. Pant, J.—Applicant Salman, who is in jail in connection with Crime No. 424 of 2010, relating to offences punishable u/s 3/5/11 of Uttarakhand Cow Progeny Protection Act 2007, police station Landhora, Kotwali Manglaur, District Haridwar, has sought his release on bail.

Heard learned Counsel for the parties.

Learned Counsel for the applicant submitted that the applicant is not named in the first information report. It is pointed out that only on making statement by some people that the scooter bearing registration No. UP 10C / 0247 belonged to the applicant, he has been arrested in connection with aforesaid crime.

Having considered submissions of learned Counsel for the parties, and after going through the papers on record, without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail.

The bail application is allowed. Let the applicant Salman be released on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Judicial Magistrate, Roorkee.
