Heard on the application filed under Section 439 of Cr.P.C. filed on 11.08.2020 for grant of bail on behalf of applicant Salman, who is confined in custody since 22.07.2020 in connection with the Crime No. 224/2019 registered at Police Station, Khalwa, District Khandwa for the offences punishable under Sections 363, 366 of IPC.
It appears from the record that the date of birth of prosecutrix is 14.10.2002. She was missing on 30.06.2019, at that time she was a girl between the age of 16 to 17 years. It is also transpires from the record that the accused and prosecutrix both left their house and they live together for some time. After two months, they came back but when the parents of the prosecutrix contacted to the prosecutrix then she denied to come back at home. Thereafter, both were residing at Pune. They were living as husband and wife. On 23.11.2019, the prosecutrix expired in a accident of burning. The marg was also registered and it is found that the death was the result of accident.
Therefore, looking to the aforesaid all circumstances, without commenting on merits of the case, the application is allowed. Applicant Salman be released on bail upon his furnishing a personal bond in the sum of Rs.30,000/-(Rupees Thirty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court.
At the time of releasing from custody, all the instructions issued by the government related to Covid-19 shall also be followed by the concerned authority.
Accordingly, this M.Cr.C. stands allowed.
