Judgment
The petitioner is seeking anticipatory bail in FIR No.
218, dated 14.11.2016, under Sections 406, 420 IPC, registered at
Police Station Kotwali, District Patiala.
Learned counsel for the petitioner contends that the
FIR is outcome of differences between the petitioner and
complainant for setting up of Bar and Saloon in pursuance to a
franchise agreement for which the complainant has also filed a
civil suit, which is pending before the trial Court.
A Coordinate Bench of this Court vide order dated
21.03.2017, had directed the petitioner to join investigation and
in the event of his arrest, he was ordered to be released on ad-
interim bail to the satisfaction of Arresting/Investigating Officer,
subject to the conditions envisaged under Section 438(2) Cr.P.C.
Learned State counsel, upon instructions from ASI Joginder Singh, states that in pursuance to the order dated
21.03.2017 the petitioner has joined investigation on 19.05.2017
and 27.08.2017.
The FIR appears to be outcome of differences in
pursuance to a franchise agreement, for which a civil suit is
pending. The petitioner has appeared before the Investigating
Officer in pursuance to the order of a Coordinate Bench of this
Court.
In view of the above and without expressing any
opinion on the merits of case, the order dated 21.03.2017,
granting ad-interim bail to the petitioner, is hereby made
absolute. However, the petitioner shall abide by the conditions
envisaged under Section 438(2) Cr.P.C.
The petition stands disposed of accordingly.
