Judgment
The earlier orders disclose that sufficient opportunity has been granted to the respondent to appear and contest the petition. But it has chosen not to appear. Hence, the prayer for ex-parte hearing deserves to be allowed.
Learned counsel for the petitioner has pressed M.A. No. 446 of 2021 seeking impleadment of some other entities as petitioners. It is always open for an aggrieved person to file an independent petition. There is no good reason to permit 3rd parties to be impleaded as petitioners in the present petition when the matter is ripe for ex-parte hearing in respect of the case of the petitioner. Hence, the prayer in M.A. No. 446 of 2021 is declined but with liberty that parties seeking to be added as petitioners, if so advised, may prefer separate petitions.
Post the matter before the Court of Registrar on 28.3.2022 for passing necessary orders and directions to make the petition ready for hearing.
The matter shall be heard ex-parte if the respondent does not appear by the next date.
