The petitioners are accused Nos.1 and 2 in Crime No. 372 of 2023 of Tanur Police Station, Malappuram District for offences alleged under Section 498A r/w Section 34 of Indian Penal Code.
The accused Nos. 1 and 2 are the husband and father in law of the defacto complainant. The Crl.M.C. has been filed on the averment that the matter has been settled between the parties. This Court had on 04.03.2025 directed the learned Public Prosecutor to get instructions regarding the genuineness of the settlement claimed by the petitioners and notice was also issued to the defacto complainant though the Investigating Officer. There was a further direction to make available the statement of the defacto complainant as regards the settlement of the issues.
The learned Public Prosecutor submitted that instructions have been received stating that the settlement claimed is genuine and he has also submitted that the defacto complainant is also represented through counsel.
In view of the settlement arrived at, I do not find any reason to continue with the prosecution in this case.
The Crl.M.C. is allowed and all further proceedings pursuant to Annexure-A2 charge sheet in Crime No.372 of 2023 of Tanur Police Station, Malappuram District pending as C.C. No. 633 of 2023 on the files of the Judicial First Class Magistrate Court, Parappanangadi are quashed.
