Judgment
Ravindra Maithani, J
Delay in filing counter affidavit is condoned. Counter affidavit is taken on record. Delay Condonation Application IA No.2 of 2024 stands disposed of, accordingly.
Applicant Sajjad Husain is in judicial custody in Case Crime No.193 of 2023, under Sections 302, 304B, 120B and 34 IPC, Police Station- Pulbhatta, District-Udham Singh Nagar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
Learned Senior Counsel appearing for the applicant would submit that the FIR was lodged against the husband, the father-in-law, the mother-in-law, sisters-in-law and others; the mother-in-law and the sisters-in-law have already been exonerated; sister-in-law and brother-in-law have already been granted bail by this Court; there are general allegations against all the accused. Therefore, it is a case of parity.
Learned State Counsel would submit that co-accused, who are brother-in-law and sister-in-law of the deceased, have already been granted bail. .
Having considered, this Court is of the view that it is a case fit for bail and the applicants deserve to be enlarged on bail.
The bail application is allowed.
Let the applicants be released on bail, on their executing a personal bond and furnishing two reliable sureties, each of the like amount, by each one of them, to the satisfaction of the court concerned.
