Judgment
A.J. Desai, C.J.
By way of the present writ petition filed in the nature of public interest under Article 226 of the Constitution of India, the petitioner has sought for the following reliefs:-
“i) To issue a Writ of Mandamus or any other appropriate writ, direction or order, directing the 3rd respondent to consider and pass appropriate orders on Exhibits P5 and P9 representations filed by the petitioner within a time frame fixed by this Hon'ble Court;
ii) To declare that the 8th and 10th respondents have illegally converted the tea plantation and they are liable to be proceeded with under the provisions of Essential Commodities Act, 1955 and the Kerala Land Utilization Order, 1967;
iii) To issue a Writ in the nature of Mandamus, or any other appropriate writ, direction or order, directing the 3rd respondent and other concerned officers to initiate proceedings for violation of the provisions of Kerala Land Reforms Act committed by 7th and 9th respondent.
iv) To issue a Writ of Mandamus or any other appropriate writ, direction or order, directing the 3rd respondent to act and exercise his authority under Clauses 7, 9 and 12 of the Kerala Land Utilization Order, 1967 to put the illegally converted land to cultivation of the deprived food crop;
v) Te issue a writ in the nature of mandamus, or any other appropriate writ, direction or order, directing 3rd respondent to initiate land ceiling proceedings against the 7th and 9th respondent invoking the provisions of section 85 of the Kerala Land Reforms Act.”
Having heard the learned Advocate appearing for the petitioner, we dispose of this writ petition with the following directions:-
The 3rd respondent is hereby directed to consider and pass orders on Exts. P5 and P9 representations, in accordance with law. The order shall be passed only after providing an opportunity of hearing to all concerned.
