Judgment

This application is preferred by the Applicant for temporary bail for a period of 30 days on the ground of surgery of the father of the applicant.
Heard learned Advocate for the Applicant and learned APP for the Respondent – State as well as learned advocate Mr. Kshitij M. Amin for the respondent No.2.
Learned Advocate for the Applicant has submitted that the applicant preferred temporary bail application before this Hon’ble Court by way of Criminal Appeal No.910/2024 and vide order dated 01.05.2024, this Hon’ble Court was pleased to grant bail to the applicant for a period of 5 days i.e. from 08.05.2024 to 12.05.2024 with police escort, however, unfortunately the jail authority has released the applicant on 11.05.2024 instead of 08.05.2024. It is also submitted that applicant has surrendered on 13.05.2024.
Learned APP has drawn attention of this Court to the Jail report, which indicates that the applicant has undergone more than 9 Years and 8 months of sentence.
Considering the facts and circumstances of the case, this Court is of the opinion that the present application requires consideration and the same is therefore partly allowed. The Applicant - SAIYED IMRAN @ IMRAN BAPU is ordered to be released on temporary bail for a period of 5 Days from the date of actual release on the Applicant’s furnishing a personal bond of Rs.5000/- to the satisfaction of the concerned authority, on usual terms and conditions. The Applicant is ordered to be released on Temporary Bail with the Police Escort at the cost of the applicant. The other conditions imposed by the Sessions Court shall remain as it is.
The Applicant shall surrender before the concerned jail authority on expiry of the temporary bail period.
Rule is made absolute accordingly. Direct service permitted.
