Petitioner has sought the following relief :

i) This Hon''ble Court may kindly be pleased to Quash the order dated 13-08-2012 (Annexure P-7)

ii) This Hon''ble court may kindly be pleased to issue appropriate writ/order/directions to the respondent to grant permission with immediate effect for start GNM course, Post B. SC Nursing course, for BSC Nursing course.

iii) This Hon''ble Court be further pleased to direct the respondent to grant approval to admit students and for listing/participation of the petitioner institute in the counseling with immediate effect.

iv) Any other relief which this Hon''ble Court may deem fit and proper in the given facts and circumstances of the case may also be granted.

The case of the petitioner is very short one. As per order Annexure P-7 dt. 13.9.2012 the petitioner institution was directed to rectify the deficiencies and thereafter to apply for re-inspection of the institution. The petitioner has rectified the deficiencies as pointed out by the respondents and applied for re-inspection along with the fees, but, till date the re-inspection has not been carried out and no order has been passed by the respondents for grant of recognition for BSC Nursing, GNM and Post B SC Nursing courses. It is submitted that the respondents be directed to carry out the re-inspection in respect of the deficiencies within a period of one week from today and to pass an order in respect of grant of recognition so that the petitioner may get intake in this year itself as the last date of counseling is 30.9.2012.

Shri Mohan Sausarkar, Learned Counsel appearing for respondents No. 1 and 2 has submitted that looking to the deficiencies as pointed out by the respondents and as per the application filed by the petitioner, as a special case, the respondents shall carry out re-inspection within a period of one week from today and shall pass an order forthwith, but, this concession may be treated only for this case and be not treated as precedent in other case.

Considering the peculiar facts of the case, we allow the prayers of the parties and disposed of this petition with the following direction :

The respondents No. 1 and 2 to carry out re-inspection in respect of the deficiencies of the petitioner institution within a period of one week from today and to pass an order forthwith. The order of the respondents No. 2 shall be communicated to the petitioner forthwith so that the petitioner may get the benefit if any of the order.

With the aforesaid direction this petition is finally disposed of with no order as to costs. C.C. as per rules.
