1.

This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 310/2026 registered at Police Station City Kotwali, District Raigarh (C.G.), for the offence punishable under Sections 309(6), 3(5) of BNS.

2.

This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 309/2026 registered at Police Station City Kotwali, District Raigarh (C.G.), for the offence punishable under Sections 115(2), 126(2), 296, 351(3), 309(6), 118(1) and 3(5) of BNS.

3.

As per the contents of the FIR lodged by Abhishek Nagraj on 10.06.2026 at about 11:45 pm, while he was going to Indiranagar, accused Sunny Sarthi along with his associate, stopped his motorcycle and looted his cellphone at knifepoint. On such complaint, the police registered an FIR for the commission of offences punishable under Sections 309(6) and 3(5) of the BNS.

4.

The second FIR was lodged by Kishan Sahu, who stated that on 10.06.2026 at about 9:30 p.m., while he was going to Madhuvanpara, Raigarh along with his friend, he was stopped by co-accused Sunny Sarthi and his associate, who allegedly looted ₹ 200/- cash and his motorcycle bearing registration No. HR 10 9190. It is further alleged that co-accused Sunny Sarthi inflicted knife blows on back and hands of the complainant. On such complaint, the police registered an FIR for the commission of offences punishable under Sections 115(2), 126(2), 296, 351(3), 309(6), 118(1) and 3(5) of the BNS.

5.

Learned counsel for the applicant would argue that applicant is innocent and has been falsely implicated in these cases. He further submits that the applicant was not named in either of the FIRs and he has subsequently been implicated in both cases on the basis of memorandum statement of co-accused Sunny Sarthi. It is further argued that police seized knife and looted articles from possession of co-accused Sunny Sarthi, whereas only looted mobile phone was seized from possession of the present applicant. It is argued that charge-sheet has already been filed, applicant is in jail since 10.06.2026 and he has no other criminal antecedents apart from the present two cases. He would pray for grant of bail to the applicant in both the cases.

6.

On the other hand, learned counsel for the State would oppose the bail applications and submit that present applicant along with co-accused Sunny Sarthi, committed robbery of a motorcycle, cellphone and cash from two complainants. They would contend that the FIRs were promptly lodged and Sunny Sarthi was named in both FIRs. It is further contended that the present applicant was involved in commission of aforesaid offences, and therefore, both bail applications deserve to be rejected.

7.

I have heard learned counsel appearing for the parties and perused the case diary.

8.

Having considered the facts and circumstances of the case, nature and gravity of allegation levelled against the present applicant and fact that alleged loot was committed by co-accused Sunny Sarthi at knifepoint; motorcycle and cash were recovered from said co-accused, who also inflicted knife injuries on one of the complainants; name of present applicant surfaced in the memorandum statement, charge-sheet has already been filed, applicant is in jail since 10.06.2026, and conclusion of the trial is likely to take some time, without commenting on merits of the case, I am inclined to allow both the bail applications.

9.

Accordingly, both the bail applications are allowed and it is directed that in event of the applicant executing a personal bond for a sum of Rs. 50,000/-with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:-

(i)

he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;

(ii)

he shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii)

he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
