The instant civil misc. arbitration appeal under Section 37(1) (B) of the Arbitration and Conciliation Act, 1996 has been filed by the appellants-non-

claimants challenging the order dated 06.08.2016 passed by the learned District Judge Pali, by which the learned Judge dismissed the application filed

by the appellants under Section 34 of the Arbitration and Conciliation Act challenging the award passed by the learned Sole Arbitrator vide order

dated 10.02.2013, whereby the learned Sole Arbitrator passed ex-parte award against the appellants and affirmed the same.

Both learned counsels for the parties submit that in compliance of the order dated 14.07.2021 passed by this Court, the appellants have deposited the

entire amount of award, therefore, the order dated 10.02.2013 passed by the learned Sole Arbitrator and order dated 06.08.2016 passed by the learned

District Judge Pali, in Civil Misc. Case No.21/2013 (Sahara India Commercial Corporation Ltd. & Ors. Vs. Smt. Basanti Devi & Anr.) may kindly be

quashed and set aside.

Since the appellants have deposited the entire amount as awarded, therefore, the impugned orders dated 10.02.2013 and 06.08.2016 are hereby

quashed and set aside.

The civil misc. appeal as well as stay application is disposed of accordingly.
