Judgment

This third application under Section 439 of Cr.P.C. has been filed for grant of bail. The second application was dismissed by order dated 8.2.2021 passed in M.Cr.C.No.5538/2021.
The applicant has been arrested on 16.10.2020 in connection with Crime No.990/2020 registered at Police Station Cantt, District Guna for offence under Section 392 of IPC.
In view of the fact that the applicant was identified by the complainant in the Dock as well as non-explanation of Rs.3,63,200/-which was allegedly recovered from the possession of the applicant, no case is made out for grant of bail.
At this stage, it is submitted by the counsel for the applicant that most of the material witnesses have been examined and the trial has reached to an advanced stage, therefore, the Trial Court may be directed to conclude the trial as early as possible.
Considering the fact that the speedy trial is the fundamental right of an accused, therefore, the prayer for direction to the Trial Court for expeditious disposal of trial is accepted. Subject to pendency of other cases on the Board of the Trial Court, it is directed that the Trial Court shall make every endeavour to expedite the trial.
With aforesaid observation, the application is dismissed.
