The present bail application has been filed under Section 439 Cr.P.C. on behalf of the applicant, who is in custody in connection with FIR No. 63/2017,

Police Station Mandwa, District - Udaipur for the offences under Sections 19/54 of the Rajasthan Excise Act, Sections 307, 332, 353, 224 of IPC and

Section 3/25 of the Arms Act.

Learned counsel for the applicant submits that the allegations against the applicant are of offences, which are triable by Magistrate and merely

because the applicant is the registered owner of the vehicle, he has been implicated and, therefore, he may be enlarged on bail.

Further submissions have been made that several co- accused have been granted bail by coordinate Benches of this Court and that the allegations

against the present applicant are not different from the allegations made against the said - co- accused.

Further submissions have been made that the applicant is in judicial custody since long and looking to the 2 nd wave of Covid- 19, the applicant may

also be granted bail.

Learned Public Prosecutor opposed the bail application. In the circumstances of the case, without expressing any opinion on the merits of the case,

this Court is of the opinion that the bail application filed by the applicant deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the accused-applicant - Sagar Mal S/o Sh. Bodu Ram arrested in connection with FIR

No. 63/2017, Police Station Mandwa, District - Udaipur, shall be released on bail; provided he furnish a personal bond of Rs.50,000/- (Rupees Fifty

Thousand Only) with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the

stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
