Judgment
K.Babu, J.
This Crl.M.C is filed seeking the following relief:-
“.....to direct the Learned Fast Track Special Court, Pattambi to consider the bail application being filed by the petitioner in L.P.No.3/2022 on the date of surrender of the petitioner itself and to release him on bail on the same day itself, so as to secure the ends of justice.”
The petitioner is the accused in L.P.No.3/2022 on the file of the Fast Track Special Court, Pattambi.
The offences alleged against the petitioner are punishable under Sections 354-A(1)(i) of IPC and Sections 8 and 7 of the Protection of Children from Sexual Offences Act 2012
Heard both sides.
Due to the non appearance of the petitioner in the Court below the case was transferred to the register of Long Pending cases and non-bailable warrant was issued against the petitioner.
It is submitted that the petitioner is prepared to surrender before the Court below. The petitioner shall surrender before the Court below within a period of two weeks from this date. If the petitioner appears before the Court below and files an application seeking regular bail, the same shall be considered and decided on the date of filing itself, in the light of the principles declared by the Apex Court in Satender Kumar Antil v CBI [(2022) 10 SCC 51].
Non-bailable warrant issued against the petitioner shall stand recalled.
The Crl.M.C is disposed of as above.
