Judgment
On 02.04.2024, Mr. Sharad Kaushal, learned AC to AAG-III was directed to take instruction with respect to the encroachment in Dhakni Pokhar Talab as well as the Graveyard in the District of Hazaribag. Today, he has submitted that though the matter was informed to the Deputy Commissioner, Hazaribag, but no instructions have been received from her.
As we have noted in the order dated 02.04.2024, the report of the Officer-in-Charge, Lohsinghna P.S., District Hazaribag dated 01.12.2021 reveals a bleak picture as the area in question seems to have become a haven for the land mafias as apart from encroaching upon the pond, encroachment has also been carried out in the Graveyard and plotting of land has been done. The report of the Officer-in-Charge, Lohsinghna P.S., Hazaribag has been brought on record through a counter affidavit filed by the Superintendent of Police Hazaribag.
As submitted by learned AC to AAG-III no instructions have been received and the matter in question appears to be serious in nature with respect to land grabbing by the mafias and in such circumstances, let the Deputy Commissioner, Hazaribag remain physically present on 04.04.2024 at 10.30 a.m. to explain to this Court as to what steps have been taken for removal of the encroachment in the backdrop of the report dated 01.12.2021 of the Officer-in-Charge, Lohsinghna P.S., District Hazaribag.

Let a copy of this order be handed over to the learned counsel for the respective parties.
