Judgment
The petitioner has preferred this writ petition under Article
226 /227 of the Constitution of India for issuance of writ of mandamus for
directing the respondents to release the service-cum-retirement benefits of the
petitioner i.e. gratuity, leave encashment, arrears of DA alongwith interest.
Learned counsel for respondent No. 4 stated that the entire
payment towards retiral benefits has been released to the petitioner.
Now, the only claim survives for consideration is for the interest
on the delayed payment.
Since, the petitioner retired from service on 30.06.2015 and the
payment of retiral benefits was released in June 2016, therefore, the
respondents are liable to pay the interest on the delayed payment.
It being so, respondents are directed to pay interest @ 9% per
annum on the delayed payment of retiral benefits of the petitioner starting three
months from the date of retirement of the petitioner till actual payment is
made.
Accordingly, the present petition stands disposed of.
