Learned counsel for the petitioners has submitted that though there are defect nos. 4, 5(c) and 9(i) to (iii) in the bail application as pointed out by the stamp reporter but he has filed an undertaking that he shall remove the defects within 30 days after the physical court starts and the bail application may be heard, as it is a regular bail application of the petitioners and petitioners are in custody since 28.02.2020.

Considering the same, this Court is inclined to hear the bail application on merits but with condition that petitioners shall remove the defects within 30 days after the physical court starts.

Joint Registrar (Judicial) is directed to ensure the compliance of this order after the physical court starts so as to remove the defects. Heard, learned counsel, Mr. Prabash Jha on instruction of learned counsel for the petitioners, Mr. Anjani Kumar and learned counsel for the State, Mr. Suraj Verma.

Learned counsel for the petitioners has prayed for grant of regular bail in connection with Manjhari P.S. Case No.15 of 2020, corresponding to N.D.P.S. Case No.05 of 2020, for the offence registered under Sections 18, 20, 22, 25, 27(A) and 46 of the NDPS Act.

Learned counsel, Mr. Prabash Jha has prayed for an adjournment in this case on the ground that learned counsel for the petitioners, Mr. Anjani Kumar is not available for argument.

It appears that one of the co-accused, Salu Purty @ Mangra Purty and Dum Singh Purty @ Dhan Singh Purty have jointly prayed for regular bail vide B.A. No. 4805 of 2020, which is pending before this Court, as such, it would be proper if the instant application is also heard along with B.A. No.4805 of 2020.

In the meantime, learned counsel for the State is directed to file a detail counter-affidavit including the FSL report of the seized material and the material collected by the police with regard to cultivation of opium by the petitioners.

List this case after four weeks along with B.A. No.4805 of 2020.
