Judgment
Heard applicant, Shri Sachin Goyal who has appeared virtually in person.
This Original Application under Sections 14 and 15 of National Green Tribunal Act, 2010 has been registered on a letter petition dated 18.01.2023 received from Shri Sachin Goyal S/o Shri Surender Kumar Goyal, resident of Ward No. 05, Pilibanga, and Shri Ganesh Kumar S/o Shri Hansraj Sharma, resident of Ward no. 12, Pilibanga, District Hanumangarh, State of Rajasthan.
The complaint is that at Bhartiya Puratatav Sangrahalya, Pilibanga, District Hanumangarh, about eight brickkilns at 2.5 km Mandi Pilibanga side, and seven brickkilns on Devnagar road side of Kalibanga Kainchi are operating. These brickkilns are not observing siting criteria, emitting black smoke and causing air pollution affecting health of the local residents.
However, neither details and names of the alleged brick kilns who are allegedly running illegally, are given nor particulars of brick kilns whereon such brick kilns may be identified, are given. Even it is not stated as to when those brickkilns were established though when query was made, he said that many brickkilns were started more than 10 years back.
In absence of the particulars of persons against whom an action is sought, this Tribunal cannot issue any such direction. Since details in the application have not been given, we find that it is not a fit case where any further order is required to be passed.
The application is rejected, subject to liberty to applicants to approach Tribunal afresh in accordance with law, with better particulars and details, if any cause of action survives.
