Judgment
Gajendra Singh, J
This is the applicant's first bail application filed under Section 483 of B.N.S.S./ 439 of Criminal Procedure Code, 1973, as he is implicated in connection with Crime No.475/2016 registered at Police Station Barwani, District Barwani (MP) for offence punishable under Sections 420, 409, 120-B of IPC and Section 3, 4, 5 and 6 of Prize Chit and Money Circulation Act, 1978. The applicant was arrested on 24.8.2022.
As per the case of the prosecution, the applicant along with other co-accused persons was involved in the aforesaid case of fraud involving Rs.50 Crores.
Counsel for the applicant has submitted that the applicant has been falsely implicated in this matter. He is in custody since 24.8.2022. The main accused Baljit Singh Sandhu has already been granted bail by this Court vide order dated 23.9.2025 passed in MCRC No.36304/2025. Thus, he prays for grant of bail on the ground of parity.
Counsel for the State has opposed the prayer.
Having considered the rival submissions, on perusal of the documents filed on record, and the fact that applicant is in custody since 24.8.2022 and co-accused Baljit Singh has already been enlarged on bail, this Court finds that the further custody of the applicant would not be necessary.
Accordingly, without commenting on the merits of the case, the application filed by the applicant is allowed. The applicant-Sachin Damor is directed to be released on bail upon furnishing a personal bond in the sum of Rs.50,000/- with one solvent surety of the like amount to the satisfaction of the trial Court for his/her regular appearance before the trial Court during trial with a condition that he shall remain present before the court concerned during trial and shall also abide by the conditions enumerated under Section 437 (3) Criminal Procedure Code, 1973.
