V.D. Gyani, J.—Heard learned Counsel for the Petitioner as also the learned Govt. Advocate.

By order dt. 11.9.96, it was observed that an endeavour shall be made to dispose of the Civil Rule on the date of return. Although no return has been filed, learned Govt. Advocate appearing for the Respondent State submits (hat the Petitioner''s case may be considered along with others. Petitioner seeks a direction to the Respondents for being regularised in service. He is presently employed as a substitute in the Health Department as Grade-IV employee. Regularisation presupposes existence of vacant and sanctioned post and the Petitioner is not the only claimant, it should be opened to all similarly placed, even if there be such vacancies. In the event of such vacancies of sanctioned post exist, on Petitioner''s application, his case be considered along with other similarly placed, subject of course to the fulfilment of other eligibility conditions and requirements.

With this direction, the petition stands finally disposed, with no order as to costs.
