Heard on application filed on 20.01.2021 under Section 439 of the Cr.P.C. on behalf of applicant Sachin alias Nannu, who was arrested on 07.01.2021
in connection with Crime No.11/2021 registered at Police Station Begumganj, District Raisen (M.P.) for the offences under Sections 363, 366 of the
I.P.C. and Section 11/12 of the POCSO Act.
It appears from the impugned order that date of birth of the prosecutrix is 08.06.2004. The missing person report was lodged on 06.01.2021.
Therefore, at the time of incident, the prosecutrix was a girl above the age of 16 years and below the age of 18 years.
Counsel for the State read out the statement recorded under Section 164 of the Cr.P.C.
Therefore, looking to the aforesaid statement and other circumstances of the case, without commenting upon the merits of the case, the application is
allowed. It is ordered that applicant Sachin alias Nannu shall be released on bail upon his furnishing a bail bond worth Rs.30,000/- (Rupees Thirty
Thousand Only) and a personal bond of the same amount to the satisfaction of the Trial Court.
At the time of releasing the applicant from custody, all necessary instructions issued by Government related to COVID-19 shall also be followed by
the concerned Authorities.
Accordingly, this M.Cr.C. stands allowed.
