Judgment
This matter is taken up through video conferencing mode.
This petition has been registered on the complaint of one Sri Sachidananda Paltasingh about illegal construction of a multistoried building in Goutam
Nagar near Sanitorium Square, Vivekananda Marg, Bhubaneswar.
Sri Mohapatra, learned counsel appearing on behalf of Bhubaneswar Development Authority (BDA) submits that in the present case the plan was
sanctioned and approved on 18th November, 2000 prior to the coming into force of the BDA (Planning and Building Standards) Regulation of 2001.
Further, he points out that the building in question is a four storied building (stilt with three floors) with a height of 40 feet and is not a ‘high rise’
building..
In view of the explanation offered by the Opposite Party-BDA, the Court does not consider it necessary to issue any further directions.
The writ petition is accordingly disposed of
