Judgment
This is an application alleging violation of an order dated 20 March 2025. By such order it was inter alia directed as follows:
“19.Since, it has been confirmed that the construction of 3 , 4 and 5 floors of the building is wholly unauthorized, therefore, we direct the Commissioner of Police, Kolkata to issue appropriate orders so as to enable the Deputy Commissioner of Police, Port Division-1 to deploy adequate police forces to remove the occupant of the three unauthorized floors.”
There have been numerous rounds of allegation by and between the parties. Ultimately by an order dated 27 July 2026 the Court had after recording the fact that a substantial portion of the 3rd, 4th and 5th floor of the subject premises had been demolished granted further time to complete the remaining demolition works.
Pursuant to the order dated 27 July 2026, a Report dated 4 August 2026 has been filed by one Ranjan Das, Executive Engineer (Building Department), Borough-IX of Kolkata Municipal Corporation which suggests that completion for the remaining demolition work including clearance of debris would take at least 3 months. The order of which contempt has been alleged was passed as far back as on 20th March 2025 and despite a challenge to the same, the order has been upheld and has become final and binding on all the parties.
The alleged contemnors are deemed to have been aware fully of the requirement to comply with the order long ago both in letter and spirit.
It is submitted on behalf of the Kolkata Municipal Corporation (KMC) that one M/s. Dream Land Constructions having its office at 123/6/2A, Raja Dhirendra Street, Kolkata-700004 and M/s. Aerodript Constructions having its office at P-47, CIT Road, Scheme-VII M, Kankurgachi, Kolkata-700054 have been engaged for completion of the work of demolition as well as for removal of the debris.
It is further submitted on behalf of the KMC that the demolition work is in progress and would be positively completed within the stipulated time period. The KMC undertakes to serve a copy of this order on both the above entities informing them of the same.
In this regard, KMC takes full responsibility that the said entities would complete the works within the above period.
In view of the submissions made on behalf of the parties, CPAN 1094 of 2025 stands disposed of by directing the alleged contemnors to complete the work positively by 15 October 2026.
The alleged contemnors and more particularly the KMC are directed to file a Report with the Registrar General, Calcutta High Court within a period of fortnight after compliance with the above directions. A copy of the Report be also submitted to the writ petitioners.
Liberty is granted to the writ petitioner to file an appropriate application if the subsequent events so warrant in accordance with law.
