Judgment
T.R. Ramachandran Nair, J.—The Petitioner is a Part Time Sweeper who is aggrieved by Exhibit P5 order whereby he is directed to join the Regional Centre of the University at Payyannur. It is submitted that the Petitioner, after serving for some time in the University, was granted leave without allowance as per Exhibit P3 order. On 8.3.2011, he approached the 1st Respondent-University requesting the University to allow him to rejoin duty after canceling the unveiled portion of leave without allowance, as per Exhibit P4. Exhibit P5 order is passed apparently depriving the same.
The learned Counsel for the Petitioner submitted that being a Part Time Sweeper, the Petitioner will not be able to survive in the present station to which he is transferred with the meager salary he is getting. It is pointed out that there are other vacancies for accommodating the Petitioner.
The learned Standing Counsel for the University submitted that the Petitioner had applied for leave without allowance before the completion of the period of probation and therefore he will have to join the centre wherein there is a vacancy.
I am not pronouncing anything on the merits of the matter, since Exhibit P6 representation is pending before the Vice Chancellor. There will be a direction to the Vice Chancellor of the University to consider Exhibit P6 and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this judgment. The implementation of Exhibit P5 order will be kept in abeyance till orders are passed by the University.
The Writ Petition is disposed of as above.
