Heard Learned Counsel for the Appellant on I.A. No. 2078 of 2021 an application for early hearing.
The matter is listed 'For Hearing' on 29.10.2021 the Learned Counsel for the Appellant submits that the Appellant Company is a going concern.
However, around 81 employees of the Appellant Company has resigned from their jobs for the reason of delay in payment of salaries. The vendors around 1030 of the Appellant are also not paid their bills/invoices. Therefore, it is requested that the Appeal may be heard at an early date.
Learned Counsel appearing on behalf of the Respondent submits that date of hearing may not be preponed.
We have considered the submissions. An Application for an early hearing is allowed.
Learned Counsel for both the Respondents are present.
The earlier date of hearing i.e. 29th October, 2021 is cancelled and now the matter is listed for final hearing on 04th October, 2021 at 2.00 PM.
Learned Counsel representing Respondent No. 2 is directed to file Status Report and Learned Counsel for the Respondent No. 1 is directed to file the Written Submissions not more than three pages along with relevant citations.
