This Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents to consider and pass orders on merits by disposing the

written representation made by the petitioners on 25.10.2012 praying for not to lease out any stone quarry to the third parties in respect of S.No.

27/2, Thottipalayam Village, Animoor Post, Tiruchengode Taluk, Namakkal District and 376, Emapalli Village and Post, Tiruchengode Taluk,

Namakkal District. Mr. N. Srinivasan, learned Additional Government Pleader takes notice for the respondents. By consent the writ petition is

taken up for final disposal.

The mandamus to consider the representation of the petitioners not to lease out the stone quarry to the third parties is total misconceived. At this

point of time, admittedly, there is no documents to show that the respondents are taking steps to lease out stone quarry to any third parties. When

there is no material, a mere statement in the affidavit cannot be a ground to issue a mandamus. The Writ Petition is misconceived. Finding no

merits, this Writ Petition is dismissed. No costs.
