Judgment
ORDER
New IA-3134/2023:-
This application has been filed by the IRP under Section 12A of IBC, 2016 read with Regulation 30A of the Code seeking withdrawal of the main petition i.e., CP(IB)-2765/ND/2O19. It has been submitted by the IRP as well as by the Ld. Counsel appearing for the Operational Creditor that the matter has been settled between the parties and therefore the present application has been filed seeking withdrawal of the main matter.
It has been submitted that the CIRP was initiated vide order dated 30.05.2023 and the Committee of Creditors has not been constituted. Therefore, the present application has been filed under Section 12A of the Code read with Regulation 30A of the IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 seeking withdrawal of the main matter.
Having heard the submissions made by Ld. Counsel, we permit the Applicant to withdraw the company Petition i.e., CP(IB)- 2765/ND/2O19.
CP(IB)- 2765/ND/2O19 dismissed as withdrawn.
IA allowed.
