Judgment
S. Nagamuthu, J.—The petitioner is working as an Assistant Headmaster of Middle School Section of Sir M. Ct. M. Higher Secondary School at Purasawalkam, Chennai. He has come up with this writ petition, seeking a direction to the 4th respondent to consider his petition, dated 02.06.2014, wherein, he has requested along with other teachers that senior most teacher of the school should be put incharge of the Headmaster of the School, instead of one Mr. N. Sundararajan, who is incharge of the post as Headmaster.
This writ petition has come up today for admission. I have heard the learned counsel for the petitioner and Mr. P. Sanjay Gandhi, learned Additional Government Pleader appearing for respondents 1 to 4. I do not propose to issue notice to 5th respondent, because this order would not be in any manner prejudicial to the 5th respondent.
In my considered opinion, this writ petition is highly misconceived and the same deserves only to be dismissed. The reasons are many. First of all, putting a teacher as incharge Headmaster, is within the domain of the Special Officer, who is incharge of the School. Simply because, there is a petition, the 4th respondent cannot change the person, who is holding the post of Headmaster. The petitioner has got no legal right to demand that there should be change in the Headmaster post.
In view of the above, the writ petition cannot be entertained. Accordingly, the same is dismissed. No costs.
