Learned Counsel for the parties are ad idem that the position of the appellants in the present case is identical to that of the appellants in LPA 294/20131 and that, in fact these appeals are directed against the same impugned judgment of the learned Single Judge.

Ms. Sukumar, learned Senior Counsel for the appellants only points that, unlike the appellants in Sanjive Chamoli the appellants in the present case are yet to be released pensionary benefits in terms of Rule 37(A) of the Central Civil Services (Pension) Rules, 19722, though they have exercised their options.

We accordingly dispose of the present appeal in terms of the order dated 4 February 2026 in LPA 294/2013 further clarifying that, consequent to the option exercised by the appellants, pensionary benefits would be released to them in accordance with Rule 37(A) of the CCS (Pension) Rules on the basis of the last pay drawn.

The appeal is disposed of accordingly.
