Vinod K. Sharma, J.—Petitioner has approached this Court, with a prayer for issuance of writ in the nature of mandamus, directing the 2nd

Respondent college to allow the Petitioner to continue her studies or in the alternative to give her Transfer certificate.

The case of the Petitioner, is that on account of her marriage against the wishes of her parents, the 2nd Respondent on objection by her parents

not permitting her to continue the studies in the college, nor are they issuing transfer certificate, to enable the Petitioner to continue her studies, in

some other institution/college.

Learned Counsel appearing for the 2nd Respondent, stated at the bar, that the transfer certificate could not be issued to the Petitioner, as no

application from Petitioner has been received. It is also stated by the learned Counsel for the 2nd Respondent, that in case application is made for

issuance of transfer certificate, the transfer certificate will be issued immediately, on completion of formalities for the transfer certificate, like

clearance of dues etc., and no objection certificate, from departments.

In view of the fair stand taken by 2nd Respondent, the Petitioner is permitted to file application for transfer certificate, to the principal of the 2nd

Respondent college, at 10.00 am on Monday the 21st February 2011. On receipt of the application 2nd Respondent shall process the application

on that very day and issue transfer certificate subject to furnishing of no dues/objection certificate.

The writ petition is disposed off in above terms. No costs. Consequently, connected miscellaneous petition is closed.
