S. Dhanabalan And Ors vs Registrar Of Co-Operative Societies And Ors

Since the issue raised in these four writ petitions are common, with the consent of the learned counsel appearing for both sides, all these writ petitions were heard together and are being disposed of by this common order.

Though the aforesaid prayers have been sought for respectively in these writ petitions filed by these two writ petitioners or both the writ petitioners with the respective prayers, when these writ petitions were taken up for final hearing, during the last hearing it was submitted by the learned counsel for the petitioners that, though it was the stand of the respondents that there was no vacancy to accommodate these petitioners, according to the petitioners, there were vacancies and a list of vacancy had also been submitted by the petitioners and the said vacancy position submitted by the petitioners, had been referred to the learned Special Government Pleader appearing for the respondents to verify and report. Accordingly, Mr.L.P.Shanmugasundaram, learned Special Government Pleader appearing for the respondents, having verified the same, obtained a written instructions from the second respondent by proceedings dated 19.03.2021 which reads thus:

"ஞபார்வை (1) இல் காஹணும் நீதிப்பேராணை மனு தொடர்பாக மயிலாடுதுறை தொடக்க கூட்டுறவு வேளாண்மை மற்றும் ஊரக வளர்ச்சி வங்கியின் முன்னாள் மேற்பார்வையாளர்கள் திரு,எஸ்,தனபாலன் மற்றும் வீ,வீரசேகரன். ஆகியோர் தொடர்ந்துள்ள நீதிப்பேராணை மனு தொடர்பாக பார்வை(2) இல் காஹணும் கடிதத்தில் கோhpய விபரத்தினை. பார்வை (4)இல்காஹணும்மயிலாடுதுறை சரக துணைப்பதிவாளாpன் அறிக்கையின் அடிப்படையில் பின்வருமாறு தொpவித்துக்கொள்கிறேன்.

By relying upon this communication, the learned Special Government Pleader would contend that, out of the four Societies, as referred to above, as of now, only one Clerk post is available in the Society at O.S.52 Sirkali Asiriyarkal Kutturavu Sikkanam and Kadan Sangam Limited. Therefore, the learned Special Government Pleader would contend that, out of the two writ petitioners, one can be accommodated in that available vacant post. Insofar as the other writ petitioner is concerned, as and when the vacancy arises in future, he would also be considered and accommodated anywhere in the entire Nagapattinam District.

4.For the said suggestion made by the learned Special Government Pleader appearing for the respondents, the learned counsel for the petitioners would agree and accordingly, after getting instruction from the petitioners, the learned counsel appearing for the petitioners has submitted that, since S.Dhanapalan, who is petitioner in W.P.No.28222 of 2012 and W.P.No.5477 of 2010, is the senior, he may be accommodated in the said Society immediately and the other writ petitioner viz., V.Veerasekaran can be accommodated in the future vacancy that would arise in any of the Society in the Nagapattinam District.

5.I have considered the said submissions made by the learned counsel appearing for both sides and by taking note of the same, without going into the issue raised in these writ petitions on merits, this Court is inclined to dispose of these writ petitions with the following orders.

(i) That the respondents shall appoint the petitioner in W.P.No.28222 of 2012 and W.P.No.5477 of 2010 viz., S.Dhanapalan as Clerk at O.S.52 Sirkali Asiriyarkal Kutturavu Sikkanam and Kadan Sangam Limited forthwith.

(ii) In this regard, the Joint Registrar of Co-operative Societies, Nagapattinam District shall give an administrative sanction immediately to the said Society i.e., O.S.52 Sirkali Asiriyarkal Kutturavu Sikkanam and Kadan Sangam Limited and on receipt of such sanction, the necessary appointment shall be made by the Society to and in favour of the petitioner S.Dhanapalan.

(iii) Insofar as the other writ petitioner viz., V.Veerasekaran, who is the writ petitioner in W.P.No.28223 of 2012 and W.P.No.5502 of 2010, is concerned, he shall be accommodated as and when vacancy arises, in any one of the Society within the Nagapattinam District, as soon as such vacancy arise by following the aforesaid procedure i.e. on giving an administrative sanction by second respondent, the concerned Society shall make appointment of the other petitioner also in such vacancy, which would arise in near future.

(iv) The needful, as indicated above, shall immediately be complied with, within an outer limit of four weeks.

With these directions, the Writ Petitions are disposed of. No costs.
