Judgment
Upon withdrawal request by the Applicant Counsel, IA-5464/2020 is hereby dismissed as withdrawn with liberty to the Applicant to proceed in accordance with law.
As to the applications filed by the land owners and as to the applications filed against the land owners, non-applicants shall file their replies within 15 days hereof.
In 5285/2020 & lvn.P-14/2020, the Applicants Counsel have submitted that they are the land owners of the properties, upon which the Corporate Debtor side unlawfully trying to proceed with invitation of resolution plans.
The land owners counsel have stated that the approval (license) given by the Directorate of Country & Planning, Haryana was cancelled in the year 2015.
For the RP Counsel having not denied about such cancellation, we are of the view that the RP shall not proceed with processing of resolution plans until before order is passed in the applications filed by these Applicants as well as the applications filed by the RP in respect to the land-hold rights of the land owners.
List IA-5285, lvn.P-14 & IA-5473/2020 along with other pending applications for hearing on 02.02.2021.
