Judgment
W.M.P.Crl.(MD)No.19434 of 2026 filed seeking to file a single Writ Petition is ordered.
This writ petition has been filed seeking for a direction to the respondents to consider the representations submitted by the petitioners who had completed the Law Degree during the academic year 2017-2020 and permit the petitioners to participate in the Convocation Ceremony of Government Law College, Ramanathapuram, held on 19.09.2026.
Heard the learned counsel on either side and carefully perused the materials placed before this Court.
The learned counsel appearing for the petitioners submits that the petitioners, who had completed the Law Degree during the academic years 2017-2020 made representations seeking permission to participate in the Convocation Ceremony of Government Law College, Ramanathapuram, held on 19.09.2026. Since the same has not been considered, this writ petition has been filed.
The learned Special Government Pleader appearing for respondents 1 and 3 submitted that the respondents have no objection to granting the aforesaid relief to the petitioners alone.
It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.
In the light of the above observations and also the submissions made, there shall be a direction to the third respondent to consider the petitioner's representation dated 02.09.2026, on its own merits and pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.
With the above direction, this writ petition is disposed of.
