THIS is an appeal by the complainant against delayed collection of a foreign draft which was deposited for collection with the respondent on 30th July, 1988.

CASE of respondent is that on request of the complainant an overdraft facility of Rs. 10,000/- was granted on basis of this deposit to be collected and accordingly, there is no deficiency in service. For permitting the facility of overdraft, interest is to be charged from the complainant and added to it, registration cost and collection fees are to be charged. On application of the complainant, the same has also been waived. Thus, there is no deficiency in service. District Forum has considered the case stated by the opposite parties and has held that there is no deficiency in service. We are also in agreement with the District Forum. When a foreign draft is deposited for collection, respondent is not to pay the money payable. It has to wait for intimation for collection. Rather complainant has been favoured by way of permitting him to avail the overdraft facility. Therefore, there is no suffering of the complainant. On the facts of this case there being no deficiency in service, the complaint has no merit.

In the result, the appeal is dismissed. Appeal dismissed.
