Judgment
Sudhanshu Dhulia, J
This case has been heard through video conferencing.
Petitioners are a married couple who had sought protection from this Court as their marriage was being opposed at the hands of the private
respondent nos.3 and 4 who are brothers of petitioner no.1.
This Court vide its order dated 07.07.2020 had passed the following order:-
“Shri Gaurav Singh, learned counsel for the petitioners.
Shri J. S. Virk, learned assistant government advocate for the State takes notice for respondents no. 1 and 2.
Issue notice to respondent nos. 3 and 4.
List after service is effected.
Counter affidavit to be filed by then.
The case of the petitioners is that petitioner no.1 married petitioner no. 2 on 26.05.2020; thereafter, respondent nos. 3 and 4 have continued to harass
them and causes them undue loss and hardship, therefore, the instant petition to direct the respondent nos. 3 and 4 not to interfere in their peaceful
married life, etc.
Considering the plea, we are of the view that the proper interference is called for. The respondent no. 1 & 2 are directed to offer adequate protection
to the petitioners to ensure that they lead their normal life in a just and proper manner.â€
Now a short counter affidavit has been filed on behalf of the State Government, which states that the petitioners are not residing in the territory of
the State of Uttarakhand and they shifted to Village Kolki Kalan, Nakur, District Muzaffarnagar, Uttar Pradesh.
Now learned Counsel for the petitioners Mr. Gaurav Singh, has given a statement before this Court, on instructions from his clients, that petitioners
are now residing at Village Kolki Kalan, Nakur, District Muzaffarnagar, Uttar Pradesh and the petitioners do not have any threat perception at the
hands of the private respondents. The learned Counsel for the petitioners prays that he may be permitted to withdraw the writ petition.
In view of the above statement made by the learned counsel for the petitioners, the writ petition is dismissed as withdrawn.
Interim order dated 07.07.2020 is hereby vacated.
