On 04th August, 2023, we had adjourned the matter till 15th September, 2023, in order to give some further time which was required by the learned Mediator, who was trying to resolve the differences which have arisen between the parties that resulted in the present matrimonial proceeding.
Today, when the Matrimonial Appeal is taken up for hearing, the Registry places before this Court a letter dated 13th September, 2023, issued by the Deputy Secretary, Sikkim State Legal Services Authority, addressed to the Joint Registrar (J), High Court of Sikkim. This letter reveals that the case could not be settled by the learned Mediator. Let a copy of the said letter, along with its annexures, be taken on record.
Since the case could not be settled by the learned Mediator, we are left with no option but to proceed with the hearing of the instant Matrimonial Appeal together with the connected application.
On the prayer of the learned Advocates appearing for the parties, let the Matrimonial Appeal, together with IA No.02 of 2022, be listed under an appropriate heading on 20th October, 2023, for hearing.
