Present writ petition has been filed for the following reliefs:

“(i)

Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 (S.D.M., Tehsil Kiccha, District Udham Singh Nagar) to revoke the rejection order passed on the application of petitioners., whereby the application of issuance of caste certificate of petitioners has been rejected (Annexure No. 8,9,10 and 11, Page No. 35 to 42 to this Writ Petition).

(ii)

Issue a writ, order or direction in the nature of Mandamus commanding and directing the respondents to permit the petitioners to apply afresh for issuance of their Caste Certificates and to consider and issue the same in accordance with law and the Government Order dated 02.04.2013, (Annexure No. 12, Page No. 43 to 45 to the writ petition) in view of the judgment and order dated 15.06.2026 passed by this Hon’ble Court in Writ Petition,titled as Toffeek Ahmed and another vs. State of Uttarakhand and others (Annexure No. 13, Page No. 46 to 48 to the writ petition).”

Petitioners filed the instant writ petition assailing the decision of the S.D.M, Kichha, whereby the application submitted by the petitioner for issuance of Caste Certificate has been rejected. In the rejection order itself it has been specified that the petitioner would be at liberty to file a fresh application annexing the relevant documents in their favour, in accordance with the Government Order dated 02.04.2013.

Learned counsel for the petitioner submits that in similar circumstances, in Writ Petition (WPMS No. 1821 of 2026), learned Coordinate Bench, by order dated 15th June, 2026, has given a liberty to the petitioner in the said writ petition to apply afresh for issuance of caste certificate.

The present writ petition is disposed of with liberty to the petitioner to apply afresh for issuance of Caste Certificate giving detail as required in the rejection order.

In case, the said application is filed, the competent authority shall examine the case of the petitioner and pass an order, as per law within a period of 8 weeks from the date of production of certified copy of this order.
