The petitioner’s request to be included in the final voters’ list for the upcoming election to the Managing Committee of the Society, registered under the Karnataka Societies Registration Act, 1960, cannot be granted for the following reasons:

a. The election process for the Managing Committee of the Society has already commenced. As per established legal principles, once the election process begins, courts should not interfere, as doing so could disrupt the electoral process.

b. The election to the Managing Committee of the Society is conducted in accordance with the bye-laws of the Society, which operate as a contract among its members. These elections are not governed by the provisions of the Karnataka Societies Registration Act, 1960. As such, the inclusion or exclusion of members in the voters’ list is a matter to be determined by the Society’s bye-laws and the procedures stipulated therein, and not by the overarching statutory framework of the Act.

In view of the above, the petition is devoid of substance and is accordingly dismissed.
