On hearing the learned Senior Counsel appearing for the parties, it is felt that the entire records pertaining to section 145 of the Code of Criminal Procedure, 1973 proceedings relating to Roma Kanti Alley vs. Tenzing Chopel Bhutia before the Additional District Collector (HQ) Gangtok should be called for. Accordingly, the Additional District Collector (HQ) Gangtok shall forward the entire records within a period of one week hence.

Mr. K.T. Namgyal, learned Senior Counsel for the respondent desires to file a response to the stay application within the same time period. He is permitted to do so. The interim order shall continue till the next date.

A reply to the second appeal dated 20.05.2023 has been filed by the respondent. The learned Senior Counsel for the respondent desires to withdraw the same. He is permitted to do so.

List this matter on 12.06.2023 on which date the learned Senior Counsel appearing for the appellant shall also take necessary steps to formulate the substantial question of laws involved in this proceeding.
