Judgment
The facts, as noticed by this Court, are that the age of the petitioner was 17 years, 11 months and the age of prosecutrix was 16 years.
The prosecutrix alleges that the petitioner took her away from her parents house, in her statement recorded under Section 161 of Cr.P.C., the
prosecutrix states that she was taken by the petitioner to Gujarat and kept as a wife and against her wishes, the petitioner established sexual relation
with her. The sole allegation is against the petitioner-Rohit. The prosecutrix has also denied any involvement of Rakesh and Kishan.
The petitioner is in remand home since 15.08.2019 and the challan has already been filed. Looking into the young age of the petitioner and the facts
at large, without expressing anything on merits, the revision petition is allowed.
It is directed that the petitioner Rohit Meena S/o Bherulal Meena be released on bail, provided his natural guardian, father, furnishes a personal
bond in the sum of Rs.25,000/- alongwith two sureties in the like amount each to the satisfaction of the concerned Juvenile Justice Board with the
stipulation that he shall produce the petitioner before the concerned Juvenile Justice Board on all dates, till the enquiry or trial is completed. His natural
guardian, father shall ensure that the juvenile in conflict with law maintains good conduct and behaviour.
