Judgment
The petitioner has challenged the order dated 30.10.2019 (Annexure-IX) by which he was demoted to the original substantive post of Additional Chief Forest Officer, as a result of withdrawal of the order dated 31.05.2018 (Annexure VI), by which he was promoted to that post [Chief Forest Officer].
In the course of arguments, Mr. VGK Kynta, learned Senior Counsel appearing on behalf of respondents No.1 to 3, submitted that the petitioner has filed the appeal against the aforesaid order before the Executive Committee, Khasi Hills Autonomous District Council [KHADC]. He therefore, cannot avail two parallel remedies by filing the writ petition as well.
Learned counsel for the petitioner submitted that he had to directly come to this Court because constitution of the new Executive Committee, KHADC has not been notified so far.
Learned Senior Counsel appearing for the respondent-KHADC submitted that the notification of constitution of a new Executive Committee is at the advance stage and is likely to be notified within a week's time.
Having regard to the facts and circumstances of the case, this Court does not deem it appropriate to directly entertain the writ petition. The Appellate Authority is directed to hear and decide the appeal filed by the petitioner within two months from the date of the constitution of a new Executive Committee.
In view of the above, the writ petition is disposed of.
