Judgment

Heard the parties.
This bail application under Section 438 Cr.P.C. has been preferred by the petitioner apprehending his arrest in connection with Purvi Tundi P.S. Case No.41 of 2023, for the offences registered under Sections 302 & 120B of the Indian Penal Code and Section 27 of the Arms Act. The case is pending in the Court of learned JMFC, Dhanbad.
Learned counsel for the petitioner started his argument while making submission that similarly situated other co-accused persons have been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 08.05.2024 in A.B.A. No.8865 of 2023 and on this premise, prayer has been made to enlarge the petitioner on anticipatory bail.
Learned A.P.P. for the State conceded to the fact that other co-accused persons whose names have been come from the mouth of co-accused have also been enlarged on anticipatory bail by the Coordinate Bench of this Court.
On query from the Court, nothing has been pointed out to this Court to make the case of present petitioner different from those co-accused persons who have already been enlarged on anticipatory bail.
Considering the aforesaid facts, so also the fact that similarly situated co-accused persons have already been enlarged on bail, this Court is inclined to grant anticipatory bail to the petitioner.
Accordingly, the petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned JMFC, Dhanbad in connection with Purvi Tundi P.S. Case No.41 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
