Learned counsel for the petitioner Mr. V.S.Jha is present.
Learned counsel for the respondents Mr. Anish Kumar Mishra is also present.
This writ petition has been filed for the following reliefs:-
“For issuance of direction upon the respondents for disposal of the departmental proceeding which has been initiated against the petitioner and to submit final clarification on behalf of the petitioner, the letter dated 08.02.2019, contained in Memo No. 1275 (Annexure-1 to this writ application), has been issued by the respondent no. 4.
For further direction upon the respondents concerned to release the salary of the petitioner, which has been withhold since January, 2020 till date.”
Learned counsel for the respondents has submitted that a counter affidavit has been filed in the present case bringing on record the order contained in Memo No. 5300 dated 30.04.2020 whereby the departmental proceeding was disposed of prior to filing of the writ petition. The writ petition was filed on 23.11.2020. The learned counsel submits that the present writ petition suffers from suppression of material facts before this court.
Considering the aforesaid submission and the fact that the disciplinary proceeding was taken to a logical end vide order dated 30.04.2020 much prior to filing of the writ petition, no relief as prayed for by the petitioner can be granted in the present writ petition. Accordingly, the present writ petition is hereby dismissed.
