Judgment

The respondent police registered a case as against this petitioner in Crime No.51 of 2024 for the offence under Sections 409 and 506(ii) IPC and remanded him into judicial custody on 10.02.2024. Therefore, the petitioner has filed this petition seeking bail.
The petitioner is arrayed as A7 and he was working as a Manager in Ishwarya Gold Finance Company run by A1. The case of the prosecution is that the defacto complainant has availed a gold loan of Rs.1,30,000/- from A1, by pledging the gold jewels weighing 194 grams, which were sold by the Finance Company, through auction sale without issuing any notice to the defacto complainant. When the same was questioned by the defacto complainant, he was criminally intimidated by the accused persons. Hence, the case.
The learned counsel for the petitioner submits that the petitioner was working as a Manager in the Finance Company run by A1. Due to money dispute between A1 and the defacto complainant, the petitioner has been falsely implicated in this case and there is no specific overt act as against the petitioner. However, he is languishing in jail from 10.02.2024.
The learned Additional Public Prosecutor opposes for grant of bail on the ground that the investigation is yet to be completed.
Considering the rival submissions, this Court is inclined to grant interim bail to the petitioner till 01.06.2024.
Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Ambasamudram and on further conditions that:
[i] The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address.
[ii] the petitioner shall appear before the respondent Police daily at 10.30 a.m. till 01.06.2024. He has to co-operate for the investigation.
The petitioner shall surrender before the Central Prison, Palayamkottai, on 02.06.2024.
Post the matter for further hearing on 04.06.2024. The respondent Police shall file a report as to the role played by the petitioner and the co-operation of the petitioner for interrogation.
